Can a Realtor disclose my credit report to my roommate?

kelsith asked:

My roommate and I are looking for a house to rent, and the Realtor had us both apply. She called my roommate, and told her my credit score as well as other personal details. Is this legal? Do I have any recourse for it?

Absolutely not. This is a violation of the Fair Credit Reporting Act (FCRA), and can result in a civil penalty up to $2,500.

Well no, ethically she shouldn’t, but you should have no expectation of privacy from a realtor, so you can’t sue her for anything. Unless you actually have a signed confidentiality statement with anyone, you can’t enforce them to adhere to a confidential relationship.

All you can do is call her broker and complain about it, she’ll probably let her have it and it will be the last time that happens.
